Retaliation

Did your employer retaliate against you? Were you fired or disciplined for reporting unlawful conduct? We can help.

It is illegal for an employer to retaliate against an employee for reporting unlawful conduct such as discrimination, harassment, unsafe working conditions or other unlawful conduct. An employee who reports these issues to a supervisor or employee they believe has the authority to correct the issue or to a governmental issue is sometimes called a whistleblower and is protected from retaliation. Your employer also cannot retaliate against you for resisting unlawful discrimination or harassment.

Examples of Unlawful Retaliation Include:

  • Reducing an employee's hours or removing them from the schedule
  • Writing up the employee for the same conduct other employees engage in or without cause
  • Shunning the employee or making them feel unwanted in the workplace
  • Terminating the employee
  • Creating false negative performance reviews
  • Failing to consider the employee for promotions or raises

Can My Employer Retaliate Against Me For Bringing a Case or Filing a Claim?

No. Several laws in California protect employees from unlawful retaliation. The Fair Employment and Housing Act and several sections of the Labor Code prohibit employers from retaliating against or taking any adverse actions against employees who report unlawful conduct, file a claim, participate in an investigation, or assist another employee with their claim.
